1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the website located at lumeoptics.us (the "Site") and any purchase you make from it. The Site is operated by Lumé, a sole proprietor doing business as Lumé, located at 15950 Paramount Way, Frisco, Texas 75033 ("Lumé," "we," "us," or "our").

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. By ordering, you represent that you meet this requirement and that the payment method you use is lawfully yours.

3. Products, descriptions, and pricing

We work to describe our products accurately, but we do not warrant that product descriptions, images, colors, or other content are error-free or complete. Screen rendering may cause colors and finishes to appear differently than in person.

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing or description errors, including after an order has been submitted, and to cancel any affected order with a full refund.

4. Orders and acceptance

Your submission of an order is an offer to purchase. We may accept or decline any order for any lawful reason, including suspected fraud, product unavailability, or errors in pricing or availability. If we cancel an order after payment, we will refund you in full.

We may limit or prohibit order quantities per person, per household, or per address.

5. Payment

Payment is due in full at the time of purchase. By providing a payment method, you represent that you are authorized to use it and authorize us to charge the full order amount, including any applicable tax.

6. Shipping and refunds

Delivery timeframes, shipping rates, and our treatment of duties and carrier fees are set out in our Shipping Policy. Refund eligibility and process are set out in our Refund Policy. Both are incorporated into these Terms by reference.

7. Acceptable use

You agree not to use the Site to: violate any law or regulation; infringe our rights or those of any third party; transmit malicious code or attempt to interfere with the Site's operation; scrape, harvest, or collect data from the Site by automated means without our written permission; or submit false or misleading information.

8. Intellectual property

The Site and its contents — including text, graphics, logos, product photography, and the Lumé name and marks — are owned by us or our licensors and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any of it without our prior written consent.

9. Third-party links and services

The Site may contain links to third-party websites or use third-party services (including payment processors and carriers). We are not responsible for the content, policies, or practices of any third party.

10. Disclaimer of warranties

Except where prohibited by law, the Site and all products are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Nothing in this section limits any warranty or right that cannot be excluded or limited under applicable law.

11. Limitation of liability

To the fullest extent permitted by law, Lumé and its owner, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or any product purchased from us.

Our total aggregate liability for any claim relating to an order will not exceed the amount you paid for that order.

12. Indemnification

You agree to indemnify and hold harmless Lumé from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your violation of any law or third-party right.

13. Governing law and venue

These Terms and any dispute arising out of them are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. You agree that the exclusive venue for any dispute is the state or federal courts located in Collin County, Texas, and you consent to personal jurisdiction there.

14. Severability and waiver

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it.

15. Changes to these Terms

We may update these Terms at any time by posting a revised version to the Site with an updated "Last updated" date. Changes apply to orders placed after the revision is posted.
